(a)               This Privacy Policy explains how Uplift Training Club ABN 87 687 460 144, trading as Uplift Training Club, collects, holds, uses, discloses and protects personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other applicable Australian privacy laws.

(b)               In this Privacy Policy, Uplift Training Club is referred to as “we”, “us” or “our”, and a reference to “you” means any member, participant, parent or guardian, visitor, prospective customer, contractor, job applicant or other person whose personal information we handle.

(c)                We take our privacy obligations seriously and are committed to handling personal information in a way that is open, transparent and consistent with applicable privacy laws.

(f)                 We may update this Privacy Policy from time to time by publishing an updated version on our website or otherwise making it available to you, and any material changes will apply from the date the updated Privacy Policy is published or otherwise notified unless a later date is specified. We encourage you to review this Privacy Policy regularly to ensure you are aware of our current privacy practices.

TYPES OF PERSONAL INFORMATION WE COLLECT

The personal information we collect may include:

(a)                       name, address, email address, telephone number and other contact details;

(b)                       date of birth, age and parent or guardian details, where relevant;

(c)                        emergency contact details;

(d)                       membership details, membership plan, attendance records, booking records, class participation records, fitness goals, workout scores, progress records, payment status and account information;

(e)                       payment information, including payment method details and transaction records;

(f)                 health, injury, pregnancy, medical, medication, disability, physical restriction, screening and emergency information you provide to us, including responses to the Digital Screening Tool based on the APSS screening assessment, including sensitive information where reasonably necessary for our services and with your consent or as otherwise permitted by law;

(g)                       incident, injury, complaint, dispute, feedback and communication records;

(h)                       photographs, videos, audio recordings, CCTV footage and other recordings of you, with promotional use subject to any separate media consent or other consent required by law;

(i)                         information collected when you use our website, online forms, social media pages, membership platform, booking system or app, including device information, IP address, location information, page view statistics, cookies, analytics data and standard web log information;

(j)                         information you provide in connection with surveys, questionnaires, promotions, challenges, competitions, events or referrals;

(k)                        information about other people that you provide to us, such as emergency contacts, parents, guardians, children or guests; and

(l)                         any other personal information you provide to us or that we reasonably require to provide our services, operate our gym, manage health and safety risks, administer memberships, manage employment or contractor applications, protect our lawful interests or comply with our legal obligations.

PERSONAL INFORMATION OF MINORS

(a)               We may collect personal information from individuals under the age of 18 where they apply for, hold, access or participate in a membership, class, trial, event or other service we provide.

(b)               Where a member or participant is under 18 years of age, we may collect personal information from them and from their parent or legal guardian, including name, date of birth, contact details, parent or guardian details, emergency contact details, membership information, screening information, health information, consents and records relating to their participation in our services.

(c)                We require a parent or legal guardian to sign or electronically accept our membership documents, waiver, screening tool, privacy and media consent form and any other documents we reasonably require before a person under 18 participates in our services, and we may refuse or suspend participation by a person under 18 if required consents, emergency details or health and safety information are not provided or are withdrawn.

(d)               Parents and legal guardians may contact us using the details set out in this Privacy Policy to request access to, correction of, or deletion or de-identification of their child’s personal information, subject to any legal, safety, insurance, record keeping, dispute management or operational requirements that apply and any circumstances where we are required or permitted by law to deal directly with the child.

HOW WE COLLECT PERSONAL INFORMATION

(a)               We may collect personal information directly from you where reasonable and practicable, and may also collect it from third parties, including when you:

(i)                       contact us through our website, social media pages, email, telephone, SMS, online forms or other communication channels;

(ii)                      make an enquiry, book a class, attend a trial, join as a member or otherwise receive goods or services from us;

(iii)               submit a membership form, waiver, screening tool, Digital Screening Tool, privacy and media consent form, cancellation form, hold request form, survey, questionnaire or other form;

(iv)                     use our membership platform, booking system, app, payment system or other third party platform we use to operate our business;

(v)                      attend our gym, classes, personal training sessions, open gym sessions, recovery facilities, events, competitions, workshops or other activities;

(vi)                     provide health, injury, pregnancy, medical, medication, emergency contact or other screening information to us;

(vii)                    communicate with us or our staff, coaches, contractors or service providers;

(viii)                  interact with our website, social media pages, online content, advertising or promotions; or

(ix)                     apply for employment or contractor opportunities with us.

(b)               We may also collect personal information from third parties, including parents, guardians, emergency contacts, payment providers, membership and booking platforms, including Push Press, insurers, health professionals, referees, professional advisers, service providers and other people or organisations where it is reasonably necessary for our business functions or activities, or where you have consented or the collection is otherwise permitted by law.

(c)                We may collect personal information when you use or access our website, online forms or social media pages. This may include using cookies, web analytics tools and similar tracking technologies to collect information about your device, browser, IP address, website usage, page views and interactions with our online content.

(d)               Cookies are small files that store information on your computer, mobile phone or other device and allow a website to recognise your device, remember your preferences, improve website functionality and support analytics and marketing where permitted by law. If you do not want cookies to be used, you can disable cookies in your browser settings, but some parts of our website may not function properly.

USE OF YOUR PERSONAL INFORMATION

(i)                       to provide our goods, services, facilities, memberships, classes, personal training, open gym access, recovery services, events and other activities;

(ii)                      to manage memberships, bookings, attendance, payments, cancellations, holds, access control, account communications and customer service;

(iii)                     to assess whether you may safely participate in our services and to manage health, safety, injury, incident and emergency risks, including by collecting and using health information with your consent or as otherwise permitted by law;

(iv)                     to respond to enquiries, complaints, disputes, incidents, injuries, illnesses, emergencies and requests for information;

(v)                      to communicate with you, including sending administrative messages, reminders, notices, updates, safety alerts, account information and other information relating to our services;

(vi)                     to process payments, manage failed payments, recover overdue amounts and maintain transaction records;

(vii)                    to provide information to our employees, contractors, coaches, service providers, insurers, professional advisers and other third parties where reasonably necessary for our business functions or activities;

(viii)                  to operate, maintain, improve and optimise our gym, services, website, membership platform, booking systems, customer experience and business operations;

(ix)                     to manage photographs, videos, CCTV footage and other recordings for safety, security, incident management, coaching, training and operational purposes, and for promotional purposes where you have provided consent or the use is otherwise permitted by law;

(x)                      to send you marketing and promotional communications, including emails, SMS messages, newsletters, offers, promotions, events, challenges and community updates, where permitted by law and subject to your right to opt out at any time;

(xi)                     to comply with our legal, regulatory, insurance and record keeping obligations;

(xii)                    to enforce our agreements, terms, policies and rules; and

(xiii)                  to consider employment, contractor or other applications.

(b)               You can opt out of receiving marketing communications from us at any time by using the unsubscribe or opt-out function provided, or by contacting us using the details set out in this Privacy Policy, but we may still send you non-marketing communications about your membership, bookings, payments, safety matters, legal notices and service-related updates.

(c)                We may disclose your personal information to third parties located inside or outside Australia, including cloud providers, membership platforms, booking platforms, payment processors, email and SMS providers, website providers, IT providers, insurers, professional advisers, contractors, emergency services, regulators and other service providers, where reasonably necessary for our business functions or activities or as required or permitted by law. Where we disclose personal information to an overseas recipient, we will take reasonable steps to ensure that the recipient handles the information in a way that is consistent with applicable privacy laws, unless an exception under Australian privacy law applies.

AUTOMATED DECISION-MAKING

(a)               We do not use automated systems to make decisions that could reasonably be expected to significantly affect your rights or interests, but third party booking, payment, marketing or security platforms may use automated processes to support routine administration, fraud prevention, payment processing, access control or communications.

(b)               If this changes, we will update this Privacy Policy to explain the types of automated decisions we make, the personal information used in those decisions and how you can contact us about those decisions.

SECURITY

(a)               We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure, and to destroy or de-identify personal information when we no longer need it for any lawful purpose.

REQUESTING ACCESS OR CORRECTING YOUR PERSONAL INFORMATION

(b)               You may also ask us to correct personal information we hold about you if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading.

(c)                We will consider your complaint and respond within a reasonable timeframe, generally within 30 days unless the complaint is complex or further information is required.

(d)               We may need to contact you for further information before we can properly investigate or respond to your complaint.

(e)               If you are not satisfied with our response, you may be able to make a complaint to the Office of the Australian Information Commissioner or another relevant privacy regulator, although the regulator may require you to first give us a reasonable opportunity to respond to your complaint.
